SHAH ALAM: An engineering firm today called off its bid to seal the campus of Universiti Teknologi Mara (UiTM) which had earlier failed to pay a court-ordered cost of RM8,000.
Lawyer Nur Aliah Selamat, who represented Mutiara Gemilang Engineering Sdn Bhd, said the action was aborted after UiTM banked in a cheque for RM8,000 last Friday.
The company had sued UiTM for RM40.8 million on April 2017 for alleged breach of contract.
Mutiara Gemilang claimed UiTM was supposed to pay the company RM11 million for the supply and maintenance of electronic equipment used at the university’s campus in Puncak Alam, but the money was not received.
“The High Court ruled in our favour and dismissed UiTM’s applications to strike out our lawsuit and stay the court’s proceedings last August and November respectively, pending their appeal,” Aliah told reporters at a press conference in the court complex here.
She said trial judge Justice See Mee Chun had awarded the company RM8,000 in cost.
Aliah said Mutiara Gemilang had tried to get UiTM to pay the amount late last year but the university failed to do so.
“We then filed a writ of seizure against them in December, to seal their belongings,” she said.
It was previously reported that the company had entered into a RM134.5 million contract with UiTM on Dec 9, 2010. Based on the terms of the agreement, UiTM must pay Mutiara Gemilang in stages for the work the company had completed.
However, the company claimed the university paid RM11 million to an individual named Mohd Fauzi Hashim and that the money was deposited into a personal account.
The company also claimed they had to bear various costs and debts from suppliers because they did not receive the RM11 million from the university.
“We were forced to borrow money from third parties and this disrupted our financial standing,” the company had said in its lawsuit.
Mutiara Gemilang is seeking RM11 million in fees and RM29.8 million in special damages from UiTM. - FMT
