Malaysian death row duo denied leave to refer S'pore to ICJ


The leave application of two Malaysians on death row in Singapore, K Datchinamurthy and S Prabagaran, to initiate proceedings in the International Court of Justice (ICJ) was dismissed by the Kuala Lumpur High Court today.
"The court dismissed our application for leave on grounds that this is a matter that involves foreign policy and therefore the court should not interfere.
"We are disappointed. We think the court had the power (in this matter) so we will be appealing," their lawyer N Surendran told Malaysiakini today.
High Court judge Hanipah Farikullah also decided that there should be no order as to costs despite the federal counsel asking for cost of RM50,000.
The application was filed by Surendran and fellow counsel Latheefa Koya on behalf of the two men to compel the Malaysian government to refer the Singapore government to the ICJ.
Surendran, who is also Padang Serai MP, claimed that the two men been denied fair trials in Singapore and as a result, were on death row there.
Datchinamurthy and Prabagaran both face executions for separate convictions of drug trafficking in Singapore.
Their filing for judicial reviews in Malaysia was also done separately, earlier this year, through the same lawyer.

Both named the foreign minister and the Malaysian government as respondents in their judicial reviews.
Prabagaran and Datchinamurthy were found guilty in Singapore of trafficking in diamorphine, a pure form of heroine, in 2012 and 2015, respectively.
It was reported both men have petitioned for clemency from the Singapore president but have not got any response yet.- Mkini
